Terms of use and sale

These terms cover use of this Elite CES site and the sale of used commercial catering equipment by Elite Catering Equipment Services Ltd. A written order confirmation from us governs the sale if it differs from this page.

These terms are for this company only. They are not the terms of any previous trading name or another dealer at the same yard.

Trade only

Elite CES supplies used and reconditioned plant for commercial kitchens. We do not sell domestic or residential appliances on these pages. By enquiring you confirm you are buying in the course of a business.

This site

Listings, prices, and the trade desk are an invitation to enquire. They are not an offer you can accept by clicking. Photos and copy are from our floor book. A machine may sell before we update a page. If it has gone we will say so and talk through what else we have or can source.

Used equipment is described from the information we have and from inspection on our floor. Capacities, power, and colour should be confirmed when you enquire. We are not the manufacturer.

Quotes and orders

A quote is not an order. It may be withdrawn or revised until we accept your order in writing. No contract exists until that acceptance. Changes must be agreed in writing.

You may cancel a paid order within 48 hours of placing it, before we buy parts or book workshop time. After that, cancellations are at our discretion and we may charge our wasted cost, including a reasonable sum up to 25% of the order value.

Price and payment

Prices on this site are typically exclusive of VAT. VAT and any agreed delivery are added on the invoice. The price that binds is the price on our written acceptance.

Payment is due as stated on the invoice, without set-off. Time of payment is of the essence. Late balances may attract interest at 3% above Barclays Bank plc base rate, and we may pass the account to solicitors. A £40 administration charge plus legal costs may apply if we have to chase.

Delivery

Delivery dates are estimates. Time is not of the essence. Unless we agree otherwise, delivery is to the rear of the vehicle at your site. You must provide enough people and kit to unload. Risk passes on delivery. Title stays with us until we have cleared funds in full.

Inspect the goods on arrival. Report obvious damage or a short delivery in writing within one working day. You have one week from delivery to report other faults that a reasonable inspection would have found. After that we are not liable for those faults.

If you refuse a correctly tendered delivery you still pay, and we may store the goods at your risk and cost. After three months from the due date we may dispose of them.

You are responsible for checking that the machine will fit doors, corridors, and services. If you had the dimensions and it will not go in, that is not a ground for return.

Installation

Gas and electrical appliances must be installed and commissioned by a suitably qualified commercial engineer. Unless we agree a separate installation contract, you arrange and pay for that. Recommendations of local engineers are introductions only — their work is not ours.

Warranty, where it applies, starts on the day of delivery and needs a completed warranty card with the installer’s details. If the machine is not installed and in use within one week of delivery, or is installed contrary to legal connection requirements, the warranty lapses.

Warranty

Unless the order says otherwise, used Elite CES equipment carries three months’ parts-only warranty at the delivery address. It is not a labour warranty. It does not follow the machine around if you use it as transient or multi-site plant unless we agreed that in writing at quote stage.

  • Export sales are sold as seen, without warranty, against an export discount.
  • Consumable and perishable parts (door seals, washers, taps, pre-rinse sprays and the like) are excluded.
  • Fair wear, misuse, poor housekeeping (including blocked drains and scale), wrong environment, or unauthorised parts or repairs are excluded.
  • We are not liable for lost food stock or extra staffing if a machine fails.
  • Call-outs we did not authorise in writing are at your cost. If the first visit shows user or installation error, the visit is chargeable.
  • We may repair on site or bring the machine back to base. You must make it accessible.

Returns

Used goods that have been installed cannot be returned because you changed your mind. Faults in the warranty period are handled as repairs, not as a right to unwind the sale. Any other return needs our written consent, unused condition, and may carry a handling charge of at least 25%.

Liability

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, including loss of profit, and our total liability on a contract is limited to the price of the goods on that contract.

Because you buy in the course of a business, conditions implied by statute are excluded to the fullest extent the law allows. If a court ever treats you as a consumer, your statutory rights are not affected.

Site use

Use this site lawfully. Do not try to disrupt it or scrape it in a way that harms the service. Content is ours or used with permission. The trade desk is for genuine equipment enquiries.

Law

English law applies. The English courts have non-exclusive jurisdiction.
